Service Terms
These Service Terms govern purchases of the Booked By Search managed local-search service from Vortex Trend LLC, trading as Booked By Search.
1. Provider and intended use
Provider: Vortex Trend LLC, 1309 Coffeen Avenue STE 1200, Sheridan, Wyoming 82801, United States. Email: vortextrendllc@gmail.com. The service is intended for established businesses, sole traders and people actively establishing a business. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded under applicable law.
2. The service
Booked By Search provides a managed local-search service which may include a custom website, service and location page structure, technical search setup, Google Search Console configuration, Google Business Profile alignment, analytics / conversion tracking, hosting, maintenance and ongoing optimisation. The scope shown at checkout, on the order page or agreed in writing forms part of these Terms. Paid advertising spend is not included unless specifically stated.
3. Price, recurring billing and GST
The current standard subscription price displayed by this funnel is A$197 per month, billed in advance. A$197 is the full amount charged by Vortex Trend LLC for the standard monthly subscription and there is no setup fee unless a separate written quote says otherwise. Vortex Trend LLC is not currently registered for Australian GST and does not separately add Australian GST to this price.
The subscription automatically renews each monthly paid billing period until cancelled. By completing checkout, the customer authorises Stripe to charge the payment method for the recurring subscription at the stated billing interval.
4. Cancellation
The customer may cancel at any time by email to vortextrendllc@gmail.com or by a written message through an official Booked By Search support channel. Cancellation takes effect at the end of the customer’s current paid billing period. No further renewal will be charged after the cancellation becomes effective. Service continues until that paid period ends unless otherwise agreed.
Cancellation by itself does not create a right to a prorated refund for an already-paid period, except where the 30-Day First Enquiry Guarantee applies or where applicable law requires a remedy.
5. Domain, website and managed infrastructure
A domain registered in the customer’s name remains the customer’s property. During an active subscription, website code, managed hosting configuration, internal systems and service infrastructure remain part of the Booked By Search managed service unless expressly transferred in writing.
If the customer cancels and requests transferable website files for independent hosting, the current optional one-time website handover / buyout is A$1,000 unless a different amount is shown in the signed order or written agreement. Third-party licences, proprietary internal tools, hosting accounts, non-transferable integrations and ongoing optimisation are excluded unless specifically stated.
6. Customer responsibilities
The customer must provide accurate business information, lawful content, timely approvals and access reasonably required to perform the work. The customer must have the right to use all logos, photos, reviews, text and other assets supplied. Passwords should not be submitted through ordinary forms or email when a secure access method is available.
7. Launch timing
The current working target is a first build within approximately 1–2 business days after complete onboarding and a core launch around day 3–4 where content, approvals, domain access and other dependencies are available. These are working targets, not guaranteed deadlines, because customer approvals, third-party platforms and technical access can affect timing.
8. Search results and performance
Booked By Search does not guarantee a specific Google ranking, position, number of leads, revenue amount, job value or business outcome. Search visibility and enquiries can be affected by competition, location, existing authority, reviews, demand, algorithm changes, business reputation, customer follow-through and other factors outside our control. Case studies describe individual historical client experiences and are not promises of identical results.
9. 30-Day First Enquiry Money-Back Guarantee
This guarantee may also be described in marketing as the “30-Day Money-Back Guarantee”. Where the guarantee is offered at checkout, the guarantee period starts only after (a) onboarding is complete, (b) all required access and approvals have been supplied, and (c) the core website / local-search system has been fully launched. If the customer receives zero genuine new enquiries reasonably attributable to the Booked By Search system during the first 30 consecutive days after launch, the customer may request a refund of the first A$197 monthly subscription payment.
An “enquiry” means a genuine new prospect contacting the business through a tracked or reasonably attributable website / Google action, including a form submission, booking request, tracked or documented call, message click or other inbound contact generated through the launched system. Spam, tests, existing customers and duplicate enquiries do not count. The customer must reasonably cooperate with attribution review. The guarantee is limited to the first monthly subscription payment and does not cover external ad spend, domain costs or third-party fees.
10. Third-party platforms
The service may rely on Stripe, Netlify, Google, domain registrars, analytics providers, Meta and other third-party services. Booked By Search is not responsible for outages, suspensions, verification decisions, ranking or algorithm changes, or policy changes controlled by those third parties. Google Ads, Meta Ads or other paid media are separate unless expressly included in writing.
11. Testimonials and case studies
Public client names, identifiable testimonials, screenshots or case studies are used only where permission has been provided or where the material is appropriately anonymised. Results shown are historical examples and must not be understood as guarantees.
12. Liability and mandatory rights
To the extent permitted by applicable law, Booked By Search provides the service with reasonable care and skill and excludes implied terms only where they may lawfully be excluded. Nothing in these Terms limits or excludes any consumer guarantee, remedy or other right that cannot legally be excluded, including rights that may apply under the Australian Consumer Law.
13. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, except to the extent that mandatory laws applicable to the customer — including the Australian Consumer Law where it applies — cannot lawfully be excluded or displaced.
